Terms of Service
Last updated: September 28, 2026
Notice: This Terms of Service page is provided for informational purposes only and does not constitute legal advice. You should have counsel review these terms before a public launch.
1. Agreement
These Terms of Service (“Terms”) govern your use of the websites, applications, and services (collectively, the “Services”) of DriveReachAds LLC (“DriveReachAds”, “we”, “us”, or “our”). By using the Services, you agree to these Terms, including the Data Processing Addendum incorporated in Section 6.
If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts & Access
- You are responsible for maintaining the confidentiality of your credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate account and billing information and keep it up to date.
3. Subscriptions, Credits, and Billing
Paid plans are billed on a recurring basis (monthly or annually) unless canceled. Some features may use a credits-based system. Credits may be included with subscriptions and/or purchased separately.
Except where required by law, payments are non-refundable once processed. Taxes may apply.
4. Acceptable Use
You agree not to misuse the Services. For example, you will not:
- Violate applicable laws or third-party rights.
- Upload malicious code, attempt to disrupt the Services, or bypass security controls.
- Use the Services to send unlawful, deceptive, or infringing ads/content.
- Attempt to reverse engineer or resell the Services except as permitted in writing.
5. Content, AI Outputs, and Third Parties
You retain ownership of content you upload. You grant us a limited license to host, process, and display that content to provide the Services.
AI-generated outputs may be inaccurate or incomplete. You are responsible for reviewing outputs and for ensuring compliance with platform policies (e.g., Meta) and applicable laws.
The Services may integrate with third-party services (payments, ad platforms, analytics). Your use of such services is subject to their terms.
6. Data Processing and Privacy
For personal information that you or your customers submit to the Services, or that we collect on your behalf (for example, leads, credit applications, chat and messages, and visitor data from your websites), you are the “business” or “controller” and DriveReachAds is your “service provider,” “contractor,” or “processor” under applicable privacy laws. Our Data Processing Addendum (“DPA”) is incorporated into these Terms and controls if it conflicts with these Terms on data protection matters. The third parties that help us process that information are listed on our Subprocessors page. Information about your own account, users, and billing is covered by our Privacy Policy.
You are responsible for:
- Having a lawful basis for the personal information you collect through the Services, giving your customers the notices the law requires, and obtaining any consents it requires.
- Obtaining the consent the Telephone Consumer Protection Act and similar laws require before you, or the Services at your direction, call, text, or send marketing messages to anyone.
- Honoring opt-outs and privacy choices, including unsubscribe and stop requests, opt-outs of sale or sharing, and Global Privacy Control signals, and not configuring the Services to override them.
- Configuring your prices, fees, fee schedule, and pricing disclosures accurately and keeping them current; the Services display them as you configure them.
- Not entering sensitive information (such as Social Security numbers, account numbers, or driver’s license numbers) into notes, messages, listings, AI prompts, or other fields not designed for it. Use only the designated credit application fields, which are encrypted.
- Responding to consumer privacy requests on time, using the tools the Services provide.
- Controlling your users’ access, including requiring two-step verification and promptly removing people who no longer need access.
7. Compliance Tools Are Not Legal Advice
The Services include features that help with legal requirements, such as price and fee disclosures, generated privacy notices and privacy-choice pages, cookie and consent banners, form consent language, AI assistant disclosures, and window stickers and Buyers Guides. These features are templates and tools, not legal advice, and using them does not guarantee that you comply with any law.
You must review and adapt them for your business, your jurisdiction, and each advertisement. You are solely responsible for your advertising, pricing, disclosures, notices, consents, and compliance with the laws that apply to you, including consumer protection, advertising, credit and leasing, fair lending, fair housing, telemarketing, and privacy laws. Consult your own counsel.
8. Disclaimers & Limitation of Liability
The Services are provided on an “as is” and “as available” basis. We disclaim all warranties to the maximum extent permitted by law.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.
9. Termination
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you have violated these Terms or if necessary to protect the Services, users, or third parties.
After termination, the DPA governs the return and deletion of personal information we process on your behalf. Sections 6 through 8 and 11 survive termination.
10. Changes
We may update these Terms from time to time. If we make material changes, we will provide notice as appropriate. Continued use after changes means you accept the updated Terms.
11. Governing Law and Venue
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other and allowing 30 days for a resolution.
Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in the State of New Mexico, and each party consents to their jurisdiction. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
